Welcome to our website. By accessing or using this site, requesting a quote, signing a contract, or engaging our services (“Company,” “we,” “our,” or “us”), you (“Client,” “Customer,” or “you”) agree to the following Terms and Conditions. These terms govern both your use of our website and any home remodeling, renovation, or construction services we provide in Austin, Texas, and surrounding areas.
Scope of Services
We provide residential and commercial construction and remodeling services, including but not limited to:
Deck design, construction, and installation (Trex, composite, and wood)
Patio cover installation and pergola construction
Interior and exterior painting
Kitchen cabinet installation, refacing, and custom cabinetry
Bathroom remodeling and renovation
Outdoor living space design and general home improvement
All services are performed in compliance with the Texas Residential Construction Liability Act (RCLA) and applicable City of Austin building codes, permitting, and inspection requirements.
Estimates, Proposals, and Contract Changes
All written estimates are based on the information available at the time of issuance. Prices, scope, or timelines may change if conditions, materials, or design specifications change.
No changes will be made to the original scope without the customer’s written approval.
Additional work or upgrades requested by the client will result in revised pricing and schedule adjustments.
Payment Terms
Payment requirements, schedules, and methods are detailed in your signed proposal or service agreement. Unless otherwise stated:
A deposit is required prior to the commencement of work.
Progress payments are due according to the project schedule.
Final payment is due immediately upon substantial completion.
Failure to pay in accordance with the contract may result in suspension of work and enforcement of legal remedies, including filing a mechanic’s lien on the property pursuant to Texas Property Code Chapter 53.
Mechanic’s Lien Rights (Non-Payment)
If payment is not received as agreed, we reserve the right — as provided under Texas law — to file a mechanic’s lien against the property to secure the balance owed.
The customer will be notified in writing prior to filing and given a reasonable opportunity to resolve the outstanding balance.
Any filing fees, legal expenses, or administrative costs associated with the lien process will be added to the amount due.
Permits, HOA, and Site Access
Unless otherwise agreed in writing:
The customer is responsible for obtaining HOA approvals, easement permissions, and zoning clearances.
We are not responsible for delays caused by permitting issues or HOA restrictions.
The customer must ensure that the job site is accessible, safe, and free from hazards.
Use of Subcontractors
We may engage licensed and insured subcontractors to perform portions of the work. We remain fully responsible for the quality and compliance of all subcontracted services.
Taxes and Fees
Applicable Texas sales tax will be added to taxable goods and materials in accordance with state law. Labor associated with residential remodeling projects is generally not taxable under current Texas regulations.
Warranties
We warrant our workmanship for a period of [12] months from the date of substantial completion unless otherwise specified. This warranty covers labor and installation only and does not cover:
Damage caused by misuse, neglect, weather, or third parties.
Materials covered separately under a manufacturer’s warranty.
Work altered or modified after completion by someone other than us.
Liability and Limitations
We carry all required licenses and liability insurance. However, we are not liable for:
Pre-existing structural issues or concealed site conditions.
Delays caused by events beyond our control (e.g., weather, supply shortages, force majeure).
Indirect or consequential damages resulting from the use or inability to use the property.
Force Majeure
We are not liable for delays, damages, or performance failures resulting from circumstances beyond our reasonable control, including natural disasters, severe weather, supply chain interruptions, strikes, acts of government, or pandemics.
Cancellations and Refunds
Cancellations must be submitted in writing. Deposits may be non-refundable if materials have been ordered or work has begun. Refunds, if applicable, will be processed in accordance with the terms of the signed agreement.
Dispute Resolution
Before initiating legal action, both parties agree to attempt resolution through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in Travis County, Texas, in accordance with the rules of the American Arbitration Association.
The prevailing party is entitled to reasonable attorney’s fees and costs.
Consumer Rights & DTPA Notice
Nothing in these Terms is intended to waive or limit any consumer rights under the Texas Deceptive Trade Practices Act (DTPA) or other applicable consumer protection laws.
Indemnification
The client agrees to indemnify and hold us harmless from any third-party claims, damages, or expenses arising from misuse, unauthorized alterations, or improper maintenance of work after project completion.
Governing Law
This agreement shall be governed by and construed under the laws of the State of Texas and applicable federal law.
